Agreement to Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "Patient") and PactRX, LLC ("PactRX," "we," "us," or "our"), a licensed specialty pharmacy operating in all 50 states. By accessing our website at pactrx.com, using our mobile application, or enrolling in our pharmacy services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our services. We reserve the right to update or modify these Terms at any time. Your continued use of our services following any changes constitutes acceptance of the revised Terms.
Eligibility
To use PactRX services, you must:
- Be at least 18 years of age or have a legal guardian who agrees to these Terms on your behalf
- Have a valid prescription from a licensed healthcare provider
- Provide accurate and complete personal, insurance, and health information
- Reside in a state where PactRX is licensed to operate
Description of Services
PactRX provides specialty pharmacy services including, but not limited to:
- Prescription medication dispensing and fulfillment
- Medication synchronization and dose-pack preparation
- Home delivery of medications via USPS, UPS, and FedEx
- Medication therapy management and clinical consultation
- Insurance billing and claims processing
- Refill management and medication reminder services
- Care coordination with prescribers and healthcare providers
- Patient and caregiver communication via phone, SMS, and secure messaging
Our services are provided under the supervision of licensed pharmacists in accordance with all applicable federal and state pharmacy laws and regulations.
Patient Responsibilities
As a patient of PactRX, you agree to:
- Provide accurate and complete personal, medical, and insurance information
- Notify us promptly of any changes to your contact information, insurance, or health status
- Inform us of all medications you are taking, including over-the-counter drugs and supplements
- Report any known allergies, adverse reactions, or drug sensitivities
- Take medications as prescribed and follow pharmacist instructions
- Notify us of any side effects or concerns about your medications
- Pay all applicable copayments, deductibles, and out-of-pocket costs in a timely manner
- Ensure someone is available to receive deliveries at the address provided
Prescription Policy
All prescriptions must be issued by a licensed prescriber with a valid DEA registration (where applicable) and NPI number. PactRX reserves the right to verify prescriptions with the issuing prescriber and to refuse to fill any prescription that we reasonably believe is not valid, is potentially harmful, or does not meet legal requirements.
We may substitute generic equivalents for brand-name medications in accordance with applicable state laws unless the prescriber or patient requests otherwise. Controlled substance prescriptions are subject to additional verification and regulatory requirements.
Payment & Billing
PactRX will bill your insurance plan for covered medications. You are responsible for paying all copayments, coinsurance, deductibles, and charges for non-covered medications. We accept payment by credit card, debit card, and ACH bank transfer.
If your insurance denies coverage for a medication, we will notify you of the out-of-pocket cost before dispensing. Payment is due before shipment unless other arrangements have been made. Past-due balances may be subject to collection activity.
Shipping & Delivery
PactRX ships medications to the address you provide. Standard shipping is typically free for maintenance medications. Expedited shipping options are available at additional cost. Temperature-sensitive medications are shipped with appropriate packaging to maintain stability.
You are responsible for providing an accurate delivery address and ensuring that someone is available to receive packages containing medications. PactRX is not liable for delays caused by carriers, weather events, incorrect addresses, or failure to receive packages.
Returns & Refunds
Due to safety regulations, prescription medications cannot be returned once they have left our facility. If you receive a damaged, incorrect, or defective product, please contact us within 48 hours and we will arrange for a replacement at no additional cost.
Refunds for overpayments or insurance adjustments will be processed within 30 business days and returned to the original payment method.
Communications & Messaging
By enrolling in PactRX services, you consent to receive communications from us via phone, email, SMS text message, and U.S. mail regarding your prescriptions, orders, refills, deliveries, and other service-related matters.

Intellectual Property
All content on the PactRX website and mobile application, including text, graphics, logos, images, software, and trademarks, is the property of PactRX, LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.
Limitation of Liability
To the maximum extent permitted by law, PactRX shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of revenue, data, or goodwill.
PactRX's total liability for any claim arising out of or related to these Terms shall not exceed the total amount paid by you to PactRX in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

The information provided on our website and through our services is for informational purposes only and does not constitute medical advice. Always consult your prescriber or healthcare provider for medical advice, diagnosis, or treatment.
Our services are provided "as is" and "as available" without warranties of any kind, express or implied, except as required by applicable law.
Termination
Either party may terminate the pharmacy-patient relationship at any time. PactRX reserves the right to discontinue services if you fail to comply with these Terms, provide false information, engage in abusive conduct, or fail to pay amounts owed.
Upon termination, we will provide you with a reasonable supply of medication and assist in transferring your prescriptions to another pharmacy of your choice, as required by applicable law.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Syracuse, New York.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
